High Court Won't Review Ban on Sex Toys

WASHINGTON - The Supreme Court declined Tuesday to review the constitutionality of a state law banning the sale of sex toys, rejecting an appeal that said consumers have a right to sexual privacy.

Without comment, justices let stand a lower court ruling that said Alabama had a right to police the sale of devices that can be sexually stimulating.

The American Civil Liberties Union (news - web sites) filed the challenge on behalf of merchants and users seeking to overturn the 1998 state law. They say the Supreme Court's 2003 ruling in Lawrence v. Texas, which decriminalized gay sex on privacy grounds, protects sex toy users from unwarranted state intrusion in their homes.

VANCOUVER - Authorities are on the hunt for a man who made off with three vibrators from a suburban adult entertainment store.

Police said late Thursday night the man was browsing the aisles of the store when a clerk saw him stuff the vibrators into his clothing.

"The clerk clearly witnessed the male fumbling and stuffing three expensive battery operated male appendages in his clothing and decided to intercept this shoplifter," police said in a news release on Friday.

Judge Charged Over Penis Pump

OKLAHOMA CITY (Reuters) - A former U.S. state judge, who allegedly used a sex toy called a penis pump in court, has been charged with three felony counts of indecent exposure by Oklahoma authorities.

Former Judge Donald Thompson, 58, pleaded not guilty in the Creek County District Court in the northeastern Oklahoma town of Sapulpa. If convicted, Thompson could face up to 10 years in prison for each count.

At the courthouse on Thursday, Thompson was taken to a backroom where he provided a DNA sample to authorities.

Last year, a court reporter who worked for Thompson was fired after she said she saw the judge masturbate and use the penis pump during hearings. Other witnesses claimed they saw Thompson use the pump in court.

Thompson stepped down in August after the allegations came to light and the state attorney general acted to remove him from the bench.

Officials searched Thompson's courtroom and chambers, and performed tests on carpet, a chair, a trash can and the judge's robe.

A preliminary hearing has been scheduled for March 22.

Police in Concord have busted four suspected hookers as well as the alleged madam. They were doing business out of a new apartment building near the city's police station.

WHITE OAK — A Longview woman who sells sex toys has been charged with felony obscenity after White Oak police found some of her wares in her car during a traffic stop
The arrest report describes the 17 items as "obscene materials and obscene devices," but Police Chief Charlie Smith said the items were mostly lotions and objects defined in a dictionary as having the shape and often the appearance of the male genitalia, used in sexual stimulation.
How illegal is that? Prosecutors will have to decide when White Oak investigators forward their findings to the district attorney's office sometime in the next week, Smith said.
"We'll see what they do with it," Smith said.

Kathleen Elizabeth "Kathy" Grubbs, a distributor for the national company Slumber Parties Inc., calls the charge, which carries a maximum penalty of two years in jail, "kind of ridiculous."
State law appears a little less forgiving: It's illegal to "wholesale promote" obscene materials or devices. Texas statute says an obscene device is a simulated sexual organ or an item designed or marketed as useful primarily for the stimulation of human genital organs. The law allows investigators to assume that anyone with six or more of the items is intending to promote them.
In April, Kilgore police raided the Adult Book Store/Video Store at 1907 Industrial Blvd., seizing 12 large trash bags full of devices police said were being sold illegally. The raid came after an undercover officer visited the shop twice before the raid, making at least one purchase. An 11-page inventory compiled by police estimated the materials were worth $19,082. The sexual devices on the 11-page inventory ranged in price from a "Climax Band" that sold for $5.95 to a "Wild and Crazy Tickler" for $11.95; a "Hyper Sonic G" for $69.95; a "Plush Playmate" for $89.95; and a "Cyber Sexploration Kit" for $44.95.

The store owner, Robert Duggan III, was never arrested, but he agreed to plead guilty to a misdemeanor count of obscene display, a charge equivalent to a traffic ticket, and agreed to pay a fine and let police destroy the items.

Grubbs, 47, said she has been selling the items for about two months as a distributor for Slumber Parties Inc., a national sex toy party business that operates out of Ohio and Louisiana.
Slumber Parties is where the Tupperware party meets Victoria's Secret, the company says on its Web site. The distributors host women-only parties in private homes to show off their merchandise. Grubbs stresses the parties are only for adults, meaning no one allowed under age 18, and men are definitely prohibited.

"Believe it or not, there's a lot of women who go to these parties," Grubbs said. "It's very popular."

Company officials did not return a call Wednesday, but Slumber Parties claims its network of distributors sold $15 million in "romance-enriching" products, including lotions, powders, lingerie and private bedroom accessories, with prices ranging from $2.50 to $139. Sales this year are expected to reach $20 million.

The seizure of the items occured during a traffic stop on Texas 42 on Old Highway 80 in White Oak at 10:27 p.m. Monday. Police stopped Grubbs' truck after seeing her driving erratically, an arrest report said. She failed or refused to perform field sobriety tests and was charged with driving while intoxicated, and a breath test showed she had blood-alcohol levels of 0.228 percent and 0.22 percent, the report said.

Police searching her truck after the arrest found the box of erotic items. The White Oak police chief said investigators are used to finding drugs and guns, but sex toys are the first in his 22 years of experience.

"There's no telling what you'll find on one of these stops," Smith said.

Supreme Court Refuses to Hear Adult Store Appeal

MARIETTA -- Residents craving sex toys will have to search the big city or elsewhere after the U.S. Supreme Court refused this week to hear an appeal filed by two adult entertainment stores shut down in 2003.

"Marietta's a much better place without those stores. Let Atlanta have them," Marietta Mayor Bill Dunaway said Thursday.

Marietta city officials say the high court's ruling proves the city's adult entertainment ordinance is airtight, and they expect cities across the nation to use Marietta's ordinance as a template for their own.

The city's decision to revoke the stores' business licenses has survived three appeals, including one in the Georgia Supreme Court, city attorney Doug Haynie said.
Despite the fact that sexually explicit material is protected by the First Amendment, Georgia law prohibits the sale of sex toys. But attorney Alan Begner, who represents adult stores across the state, said that law has been selectively enforced.

"For some reason, Marietta decided to go to war," Begner said. "Sex toys are illegal in Georgia but are sold widely because it's a stupid law and nobody cares."

Begner said he did not expect the high court's decision to have much effect outside Marietta, which shut down the two sex shops, Inserection and Waterpipe World, and a third in July 2003.

High court could review Alabama's ban on sex toys

HUNTSVILLE (AP) — An attorney for the owner of two North Alabama sex toy stores has asked the U.S. Supreme Court to review the state's ban on the sale of the devices.

Mike Fees, a Huntsville lawyer representing store owner Sherri Williams, said he filed the motion last week and should know by the third week of February if the Supreme Court will accept his case.

The Alabama Legislature passed an anti-obscenity law in 1998 that prohibited some nude dancing, certain X-rated videos and the sale of devices designed to stimulate human genitals. Williams, who owns Pleasures stores in Decatur and Huntsville, and a woman who sold sexual aids at home parties soon filed suit challenging the ban. They were joined by others, including the American Civil Liberties Union.

U.S. District Judge Lynwood Smith Jr. of Huntsville has twice ruled against the state law, holding that it violated the constitutional right to privacy, but the state won both times on appeal.

In its 2-1 ruling in July, a panel of the 11th U.S. Circuit Court of Appeals held that the U.S. Constitution does not include a right to sexual privacy.

The setting of today’s article is a Priscilla’s. Why Priscilla’s? Well, this is a sex column, and Priscilla’s is an “adult novelty store” and so I thought I would combine the two to get STEPHEN’S SEX TOY ARTICLE.

Schuyler and I decided it was time to ramp up our sex lives. She had never received an orgasm (that sounds like a Christmas package, doesn’t it?) and I’d never received a proper prostate orgasm (like a gift from the gods).

Buying sex toys for the first time is the most unnerving thing known to man. There’s two ways you can go, either order them online or go to your local sex shop. We opted for the second.

Even though Schuyler and I were excited about going to Priscilla’s for our first sex toy experience, the minute we got in we were both nervous. I believe that it all has to deal with perception.

Sex, for most of us, is a very private act. What we do, who we do it with, and how we do it isn’t something that we broadcast. However, when you go and buy a vibrator, that’s symbolically coming out to the world and screaming “Yes, I masturbate.”

It also didn’t help that the guy working the counter was creepy (he had beady eyes and a weird smile… plus he played ska music, how non-sexy is that) and when asked what vibrator would be good to start with he answered: “something small.” That is not good service. For future workers of Priscilla’s: If someone asks you what toy to start out with, give help. Buying a sex toy is difficult, and being left in the dark is not fun.

Eventually, Schuyler and I picked our poisons. Schuyler got a slim, simple, pink vibrator, while I chose the more exotic, multi-tiered anal dildo, that starts out slim and get fatter. Unfortunately, however, it was pink and jelly.

My dildo, however, got quite the homecoming. My roommates, so excited at the prospect of me shoving things up my ass, decided to name the dildo. Reactions: Here’s my advice for sex toys. Be adventurous, but also understand that you may be disappointed at some point. Not all sex toys are for everyone. They might seem weird at first, but keep at it. You’ll find something that works.

Finally, when you are buying sex toys, make sure you are well informed on how they work, how to clean and maintain them. Scientists could be on the trail of a reversible male contraceptive that works through the immune system.
They report that they injected nine male macaque monkeys with Eppin, a protein from the testes. Seven became infertile, and of these five became fertile again when the treatment stopped.

Researchers have been experimenting for years to find reliable male hormonal contraceptives. Some are in clinical trials. But so far the only reliable male choice has been the condom, or vasectomy.

Researchers have considered immunising women to prevent conception. But the experiment by scientists from the University of North Carolina at Chapel Hill and the Indian Institute of Science, Bangalore, reported in Science today, is, they say, the first successful trial based on the male immune system.

The experiment appeared not to have triggered any other problems with the animals' immune systems.

"This study demonstrates that effective and reversible male contraception in primates is an attainable goal," the team reports.

"We see ourselves as a bit of a trailblazer," says owner Jeff Stober. The racy room-service menu - due next month - is "in keeping with the theme of sex that has always played a role in artistic works. We are embracing that artistic spirit."

Consider This: Where’s the crime in Burleson?

I think I might move to Burleson. After reading the latest issue of Texas Monthly, I figure Burleson must be completely crime free.

As you probably know, a woman in Burleson named Joanne Webb was arrested for violating the state’s obscenity law. She didn’t expose herself in public, at least not to the point of being illegal. She didn’t open a sex club or porn movie theater. She sold sex toys to women at private, invitation-only parties. But, even that isn’t illegal under Texas law. Are you ready for what got her in trouble?

She was honest about what she was selling. That’s right. She got arrested because she told the truth. Only a politician could think that makes sense. Under Texas law sex toys are only legal if they sold as “novelties.” It is illegal to sell anything designed to “stimulate the genitals.”

So, if she had told the women she was selling party favors or cake toppers or decorative items (short version, if she lied) she would have been okay. But she didn’t do that, so someone decided she needed to be stopped.

That someone apparently called local law enforcement officials, who did their duty. They sent undercover officers to purchase some of the offending items. Then, with evidence in hand, they arrested the strumpet.

I guess there were no drug arrests to be made. Apparently all the gang members, robbers and other criminals had been locked up. That’s what I meant about moving to Burleson. If all police have to do is spend their time looking for renegade sex toy peddlers, it must be a peaceful place indeed.

When I first heard this story, I couldn’t understand why anyone would care about what that woman was doing. I have lived in some pretty conservative communities.

But even in the smallest town I’ve lived in, such a woman would be the subject of gossip. She wouldn’t be arrested. If you read the Texas Monthly article, you will see there is a little more to the story.

Apparently this woman liked her breasts large and her skirts small. She was active in her community and some of the local church folk were offended by this. They thought she was not a good representative of her community. So, someone decided to put a stop to her activities. Even though her business was run in private parties attended by adults in private homes. Why can’t folks leave well enough alone?

Fortunately, the local prosecutor decided to drop the charges. I’m not sure why he did that. Perhaps he is one of the few people involved in this story with common sense. Now the woman is suing to have the state’s obscenity law ruled unconstitutional. I hope she wins.

I don’t care where you stand on the issue of pornography or sexually oriented businesses. There is something wrong with Texas’ law. I work in Houston and pass no less than five adult bookstores. Most of them advertise that they carry similar items to those the Burleson woman was selling.

In addition to that, I pass several strip clubs and billboards that advertise several others. If those aren’t designed to “stimulate the genitals,” then I don’t know what is.

The people who opposed Joanne Webb probably consider themselves politically conservative. That means they oppose big government, don’t like taxes and don’t want government officials regulating their business practices.

Isn’t it curious that they expect government to stay out of their businesses but want it to regulate everyone else’s sex lives?

SYDNEY: A sex toy vibrating in a rubbish bin has sparked a security scare and shut a regional Australian airport for almost an hour.

An emergency was declared at the airport in Mackay, 805km north of Brisbane in tropical Queensland state, after airport staff heard a strange noise coming from the bin, Australian Broadcasting Corporation radio said.

"It was rather disconcerting when the rubbish bin started humming furiously," cafeteria manager Lynne Bryant said.

Police evacuated the terminal and were about to call in bomb experts when an unidentified passenger came forward to identify the contents of a package left in the bin.

A police spokeswoman said the package was identified as an "adult novelty device".

Australia has been under heightened security alert since the September 11, 2001, hijacked airliner attacks on the United States and security at major buildings and transport hubs has been tightened even further ahead of an October 9 election.

Better sex does not have to be the stuff of dreams. For women who can't remember the last time sex was good or consider it just another chore to add to the list, there is a variety of sexual aids and devices that can really help.

Everybody's doing it. Well, almost everybody. A recent study by the Berman Center, funded by an unrestricted educational grant from Drugstore.com, found that nearly half of women ages 18 to 55 have used a vibrator. We got down to the truth about sex toys by surveying nearly 2,000 women across the country. The findings might surprise you.

For women of all walks of life, we found that using vibrators leads to better sexual functioning. These women are more interested in sex, achieve heightened arousal, have an easier time reaching orgasm and experience less pain during and after sex. This includes all sexual activity -- not just when women were using a sex aid.

It seems that practice really does make perfect. We found that women who use vibrators are more sexually satisfied in general. And women who reported high levels of sexual satisfaction were more likely to report a positive quality of life as well. So ultimately, vibrators lead to a better quality of life!

And make no mistake -- far from taking the place of a partner, sexual devices work to enhance relationship sex by giving women (and men) a window into what pleases her, which only makes sex better. More than 55 percent of women in relationships reported using a vibrator, while 34 percent of singles did so. Two-thirds of women in relationships said their partner was supportive of their use of sex toys. Nearly half used their sexual aid with a partner, in addition to using it by themselves. And get this: Four percent of women reported that their male partners borrowed their vibrators for their own use.

What vibrators give women is a tool to take charge of their sexuality, either to improve what they have or get back what they lost. The hardest part is figuring out where to begin. Sex toys are definitely not one-size-fits-all, and the choices can be dizzying if you are just starting out. I prescribe different types of vibrators every day in my practice. Here are some general guidelines I use with my patients that you may want to use for yourself. See if you fit into one of these four categories.

First-Timers: For women who have never had an orgasm, try the Hitachi Magic Wand or AccuVibe, both of which double as body massagers. These are excellent beginner vibrators, very large and powerful, so it's hard to miss the target.

Passionate Partners: Women looking to spice things up with their lovers should try the Pleasure Commander. A remote-control vibrating bullet provides endless possibilities and new sensations. Plus, men always enjoy being in charge of the remote control.

Me Too: For women who always put his pleasure before hers, the Pocket Rocket provides external stimulation to help her reach that elusive orgasm with intercourse. It's small and he'll hardly notice it's there, but you sure will.

Sensation Starved: Women who are struggling with arousal difficulties, including low sensation, should try the Hitachi Magic Wand or AccuVibe. You can borrow one from one of your First-Timer friends. Remember, vibrators are not simply about good sex. Our study found what most women already know: If you are happy in the bedroom, you're happy outside of it, too. So if you're having some trouble with your sex life, take my prescription for a better life and try a vibrator. Doctor's orders!

Sex Toys More Common in Women in Relationships

Oct. 7, 2004 - Nearly half of adult women currently use sex toys or have tried them in the past, research shows. And women in relationships are even more likely to use them.

The report comes from Chicago's Berman Center. Directed by sex therapist Laura Berman, LCSW, PhD, the center focuses on women's sexual health and menopause.

The online study, funded by an unrestricted educational grant from drugstore.com, was conducted by Knowledge Networks for the Berman Center. The results were presented at the Women's Sexual Health State-of the-Art Series conference in Chicago.

A random sample of almost 2,600 women aged 18 to 60 were invited to participate in the survey. About 1,600 agreed to complete the survey, answering questions about their relationship status and use of sex toys.

According to the survey:

Forty-four percent said they currently use a sex toy or had done so in the past. The most commonly used sex toy was a vibrator.
Young women aged 25-34 were the most likely to have ever used a sex toy, with 51% of participants in that age group reporting current or past sex toy use.
Women aged 55-60 were just as likely to have tried a sex toy at some point in their lives. However, they were half as likely as younger women to currently use sex toys.

Most current or past sex toy users were in relationships and said they did not view the devices as a substitute for a partner.

Of unmarried women living with their partners, 43% said they currently used sex toys, and 17% said they had used them in the past.
Among women in relationships who were not living with their partners, 35% said they currently used sex toys, and 21% said they had done so in the past.

Sex Toys Less Common Among Singles

Sex toy use was less common among women not in relationships. Twenty-two percent of single women said they were current sex toy users; 12% said they had used sex toys in the past.

The use of sex toys was most popular among white women and women with some college education.

Thirty-four percent of white women said they currently used sex toys, compared with 22% of black participants, 19% of Hispanics, and 8% of "other" races.
Thirty-seven percent of women with some college education (but not a degree) were current sex toy users, compared with 26% of women with a college degree and 29% of high school graduates with no college education.

Sex Toys no Substitute for Real Thing

Overall, women had a "neutral-to-positive" outlook on sex toy use.

After controlling for demographic variables, "current sex toy users, whether or not in a steady healthy relationship, were significantly more likely to report a higher level of desire and interest for sex and less pain during and following intercourse," says the report.

"However, current and former users who were not in steady healthy relationships were still less satisfied with their overall sexual life than their counterparts."

Most sex toy users (about 90%) said they were open about it with their partners. Almost two-thirds of women said their partners were supportive of their sex toy use.

The main reason cited for current or past sex toy use: curiosity.
